Terms of Service

The Site provides the following services: Geo Territories and related geolocation services (the "Services"). You agree that by accessing the Site and/or Services, you have read, understood, and agree to be bound by all of these Terms and Conditions.

If you do not agree with all of these Terms and Conditions, then you are prohibited from using the Site and Services and you must discontinue use immediately. We recommend that you print a copy of these Terms and Conditions for future reference.

We may make changes to these Terms and Conditions at any time. The updated version will be indicated by an updated date and will be effective as soon as it is accessible. Your continued use of the Site represents acceptance of any changes.

The Site is intended for users who are at least 18 years old. If you are under this age, you are not permitted to register or use the Services without parental permission.

Our Geo Territories processes and stores location-based data. By using our Services, you acknowledge and consent to:

• The collection, processing, and storage of location coordinates and geofence data
• The transmission of location data to our secure servers
• Compliance with all applicable location privacy regulations including GDPR and CCPA
• Your responsibility to obtain necessary user consent before processing personal location data

⚠️ Important: You are responsible for ensuring that your use of location data complies with all applicable laws and regulations in your jurisdiction.

You may not access or use the Site for any purpose other than that for which we make the site and our Services available. Specifically, you agree not to:

• Use location data to track individuals without their explicit consent
• Use geofence data for discriminatory, harassing, or threatening purposes
• Interfere with, disrupt, or create undue burden on the API or our networks
• Copy, adapt, or reverse-engineer our software, API code, or infrastructure
• Exceed agreed-upon API rate limits or data processing quotas
• Share your API keys or credentials with unauthorized third parties
• Submit false abuse reports or misuse our support services
• Use the service for any illegal activities or purposes
• Falsely imply a business relationship with Loomilab

Your usage of the Geo Territories API is subject to the following terms:

• API access is granted according to your subscription plan
• Rate limits and quotas are specified in your account dashboard
• Excessive usage may result in temporary throttling or service suspension
• We reserve the right to modify rate limits with 30 days' notice
• You are responsible for monitoring your API usage and staying within limits
• Overage charges may apply if you exceed your plan allocation

Uptime Service Level Agreement (SLA): We commit to 99.5% monthly uptime for the API. Planned maintenance may occur with advance notice.

You retain all rights to your data. We agree to:

• Store your geofence data according to your subscription tier
• Delete all your data within 30 days of account termination
• Provide you with a data export option at any time
• Maintain encrypted backups for disaster recovery purposes
• Never sell or share your location data with third parties without explicit consent

Data associated with free trial accounts will be automatically deleted after 7 days of inactivity.

Unless otherwise indicated, the Site and Services including source code, databases, functionality, software, website designs, audio, video, text, photographs, and graphics (the "Our Content") are owned or licensed to us and are protected by copyright and trademark laws.

You are granted a limited, non-exclusive, non-transferable license to access and use the Site and Services solely for your intended purposes according to your subscription plan. You may not:

• Reproduce or copy the API software or documentation
• Create derivative works from our Services
• Decompile, reverse-engineer, or disassemble our software
• Redistribute or resell access to the Geo Territories

The Site and Services are provided on an "as-is" and "as-available" basis.

We make no warranties or representations about the accuracy or completeness of the Site's content and are not liable for:

• Errors or omissions in location data
• Unauthorized access to or use of our servers or personal information
• Interruption or cessation of transmission to or from the service
• Any bugs, viruses, or malicious code transmitted through the service
• Accuracy of geofence boundaries or location precision
• Delays in location data processing or API responses

Our total liability to you shall not exceed the amount you paid to us in the 6 months prior to any claim.

These Terms and Conditions remain in full force and effect while you use the Site or Services. You may terminate at any time by following the account deletion process or contacting us at support@mail.loomilab.com

We reserve the right to deny access to and use of the Site and Services (including blocking IP addresses) to any person for any reason, including breach of these Terms or applicable law, without notice or liability.

Upon termination, all your rights under these Terms are immediately revoked. We will delete your data according to Section 5 (Data Retention & Deletion).

• Subscription plans and fees are specified on our pricing page
• Billing occurs automatically on your subscription renewal date
• Fees are exclusive of applicable taxes
• Subscription Fees are non-refundable except as required by law
• We reserve the right to change pricing with 30 days' notice
• You may upgrade or downgrade your plan at any time
• Subscription auto-renews unless you disable renewal or cancel your account
• Failed payments may result in service suspension
